These Terms of Service (“Terms”) govern your access to and use of the web hosting services provided by GalacticNode (“GalacticNode”, “we”, “us”). By ordering or using our services you agree to be bound by these Terms.
1. Your account
You must provide accurate, current and complete information when you sign up and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
2. The services
We provide shared web hosting and related services as described on our website and in your order. We may update, improve or modify features from time to time. We aim to provide a 99.99% uptime service level as described in our Service Level Agreement.
3. Fees and billing
- Fees are billed in advance on the billing cycle you select (monthly or annual).
- The price you sign up at is the price you renew at, unless we give you at least 30 days' notice of a change.
- Services renew automatically until cancelled. You may cancel at any time from your client area.
- All prices exclude VAT unless stated otherwise. VAT is applied where required by law.
4. Money-back guarantee
New hosting accounts are covered by a 30-day money-back guarantee. If you cancel within 30 days of your initial order, we will refund your hosting fees. Domain registrations and other one-off charges are non-refundable.
5. Acceptable use
Your use of our services must comply with our Acceptable Use Policy. We reserve the right to suspend or terminate services used in breach of that policy.
6. Backups and your responsibility
We take regular backups as a courtesy and disaster-recovery measure. However, you remain responsible for maintaining your own independent backups of your data. We are not liable for any loss of data.
7. Suspension and termination
We may suspend or terminate your services if you breach these Terms, fail to pay fees when due, or use the services in a way that harms our network or other customers. Where practical we will give you notice and an opportunity to remedy the issue first.
8. Limitation of liability
To the fullest extent permitted by law, our total liability to you in connection with the services is limited to the fees you paid us in the three months preceding the event giving rise to the claim. We are not liable for indirect or consequential losses, loss of profit, or loss of data.
9. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and, for material changes, notify you by email. Continued use of the services after changes take effect constitutes acceptance.
10. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
